Terms and Conditions of Sale

These Terms and Conditions of Sale govern the contractual relationship between:

Hereinafter referred to as “the Owner”,

And any person making a booking, hereinafter referred to as “the Guest”.

Any booking implies full and unconditional acceptance of these Terms and Conditions of Sale.

1. Purpose

These Terms and Conditions of Sale define the booking, payment, cancellation and rental conditions for the accommodation offered by Le Passage.

2. Scope

These conditions apply to bookings made directly with the Owner or via the Le Passage website.

Bookings made through third-party platforms such as Airbnb, Booking, Abritel or any other booking platform remain subject to the specific terms and conditions of those platforms.

3. Booking

A booking may be made:

  • online via the website;
  • or directly with the Owner.

The booking is considered firm and final:

  • after payment of a 30% deposit online;
  • or after actual receipt of the bank transfer in the case of offline payment.

In the case of offline payment, the booking is only confirmed once the funds have been received.

The Owner reserves the right to refuse or cancel a booking in the event of non-payment, clearly incorrect information, fraud or attempted fraud, or a previous unresolved dispute with the Guest.

4. Payment

Accepted payment methods are:

  • credit or debit card via Stripe;
  • bank transfer;
  • cash, only with prior agreement.

Prices are displayed in euros, including all taxes.

The balance of the stay must be paid before arrival or according to the terms agreed with the Owner.

5. Rates and Tourist Tax

Prices include:

  • rental of the booked accommodation;
  • bed linen;
  • bath towels.

Unless otherwise stated, the following are not included:

  • tourist tax;
  • end-of-stay cleaning;
  • additional services;
  • pet supplements.

Tourist tax is charged in accordance with the applicable regulations and appears separately at the time of booking or on the stay documents.

6. Security Deposit

A security deposit of €250 is required for each stay.

  • For online payments: a bank card pre-authorisation is made automatically and is not charged.
  • For offline payments: a security deposit cheque is requested upon arrival.

The security deposit is released after departure, provided no damage, loss, breach of these conditions or outstanding charges are identified.

7. Cleaning

End-of-stay cleaning is available as an optional service.

The applicable rates are as follows:

  • Le Dauphin:
    • €45 for a stay of 2 nights or less;
    • €75 for a stay of 3 nights or more.
  • Le Duc:
    • €35 for a stay of 2 nights or less;
    • €55 for a stay of 3 nights or more.
  • La Borne 31:
    • €15 for a stay of 2 nights or less;
    • €35 for a stay of 3 nights or more.

If this option is not selected, the accommodation must be returned clean, tidy and fully cleaned.

Otherwise, cleaning or restoration fees may be deducted from the security deposit.

8. Pets

Pets are accepted, with a maximum of two pets per stay.

A supplement of €20 per pet applies.

The Guest is responsible for any damage, disturbance or soiling caused by their pets.

9. Cancellation Conditions

Any cancellation request must be made in writing, by email or post.

Cancellation fees are as follows:

  • More than 14 days before arrival: full refund of the amounts paid;
  • Between 14 and 7 days before arrival: the deposit remains due to the Owner;
  • Less than 7 days before arrival: the full amount of the stay is due.

In the event of early departure by the Guest, no refund will be granted.

10. Arrival and Departure

Arrival is possible from 4:00 p.m.

Departure must take place before 11:00 a.m.

Access details for the accommodation are sent to the Guest before arrival.

11. Reporting Issues

The Guest must report any issue, damage or malfunction observed in the accommodation within 24 hours of arrival.

Failing this, the equipment and accommodation shall be deemed to be in the expected condition.

12. Use of the Premises

The Guest agrees to use the premises peacefully, to respect the neighbourhood and not to cause any nuisance.

The accommodation is intended exclusively for temporary residential use. Any subletting or provision of the accommodation to undeclared third parties is prohibited.

Parties, gatherings and unauthorised events are prohibited.

The Guest agrees to comply with the instructions provided by the Owner, particularly regarding the use of equipment, waste sorting, closing doors and windows, and respecting shared or outdoor areas.

13. Capacity

The number of people present in the accommodation may not exceed the maximum capacity stated at the time of booking.

Any occupancy exceeding the authorised capacity may result in immediate termination of the stay, without refund.

14. Liability and Insurance

The Guest is responsible for all damage caused during the stay by themselves, the people accompanying them or their pets.

The Guest declares that they are covered by civil liability insurance covering any damage that may be caused during the stay.

The Owner cannot be held responsible for the loss, theft or damage of personal belongings belonging to the Guest or the people accompanying them.

15. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, accommodation services provided on a specific date or during a specific period are not subject to the right of withdrawal.

Any confirmed booking is therefore firm and final, subject to the cancellation conditions set out in these Terms and Conditions of Sale.

16. Force Majeure

Neither Party may be held liable for the non-performance or delay in the performance of its obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code.

Force majeure events include, without limitation: natural disasters, fires, floods, storms, epidemics, pandemics, administrative decisions, government restrictions, widespread network outages or any unforeseeable, irresistible and external event preventing the normal performance of the contract.

In the event of such an event, the Parties shall endeavour to find an amicable solution, including postponement of the stay where possible.

If performance of the stay becomes definitively impossible, the rights and obligations of the Parties shall be determined in accordance with the applicable legal provisions.

17. Personal Data

The personal data collected is used solely for the management of bookings, compliance with legal obligations and the commercial relationship with the Guest.

Personal data is not sold to third parties.

Personal data is processed in accordance with the privacy policy available on the Le Passage website.

18. Applicable Law

These Terms and Conditions of Sale are governed by French law.

They are drafted in French. In the event of translation into another language, only the French version shall prevail in the event of a dispute.

19. Disputes and Mediation

In the event of a dispute, the Guest is invited to contact the Owner first in order to seek an amicable solution.

In accordance with the French Consumer Code, the consumer Guest has the right to use a consumer mediation service free of charge after having submitted a written complaint to the Owner.

The competent mediator and their contact details will be provided to the Guest in accordance with the applicable legal provisions.

Failing an amicable agreement, the dispute shall be submitted to the competent courts in accordance with French law.

20. Acceptance of the Terms and Conditions of Sale

The Guest acknowledges having read these Terms and Conditions of Sale before confirming their booking.

Confirmation of the booking implies full acceptance of these Terms and Conditions of Sale and the obligation to pay for the booked stay.
